In the sixty-five years since the end of World War II the most significant and formative single event in American history- beyond any question- is the Vietnam War. It reshaped our domestic politics, foreign policy, military doctrines, and popular culture in ways that still resonate powerfully nearly two generations after it ended. The Vietnam War was waged not just in the rice paddies of Southeast Asia but also in the streets and campuses of the American homeland. It divided families and regions in a manner not seen since the Civil War. It shattered the Great American Consensus that was forged in the aftermath of Pearl Harbor and that had endured through the first half of the Cold War. Millions of Americans viewed opposition to the war as high idealism, while millions more saw it as bordering on treason.

Politically the Vietnam War ultimately entirely captured the Democratic Party and profoundly influenced the Republican Party. Every military conflict involving U.S. forces since has evoked dire warnings about “another Vietnam”. A recent Newsweek cover story labeled Afghanistan “Obama’s Vietnam”. Our national conversation on foreign policy repeatedly invokes warnings against failure to heed the “lessons of Vietnam”.

What are the “lessons of Vietnam”? The received wisdom that has become embedded in our national consciousness rests principally on three ”truths” : 1. The war was “unwinnable” from the start; 2. Vietnam was a “war of national liberation” in which the Viet Cong were legitimate representatives of the people; 3. The South Vietnamese government were essentially American “puppets” with no popular support or willingness to fight.

Though the American phase of the war in Indochina lasted from 1960 to 1975 in the minds of most Americans the war ended in 1968. The “annus terriblus” of 1968 effected the most dramatic changes in American History since Pearl Harbor. The year began with the momentous “Tet Offensive” which thanks to television was graphically brought into nearly every American living room. What shocked Americans saw was not “light at the end of the tunnel” but a savagely determined enemy attacking virtually every corner of South Vietnam even including the American Embassy compound in Saigon.

In short order following the perceived calamity of “Tet” the revered sage of America’s media Walter Cronkite declared the war a “stalemate” (“They won’t quit, and we can’t win”). Eugene McCarthy, and then Robert Kennedy entered the Democratic primaries on an anti-war platform intending to overthrow the sitting President of their own party, and with great suddenness the presidency of Lyndon B. Johnson collapsed amidst the wreckage of his Vietnam policy. Additional high drama- King and Kennedy assassinations, race riots, Kids versus Cops in Chicago- punctuated a tumultuous presidential campaign in which both parties competed over who had the best plan to get out of Vietnam.

After 1968 as President Nixon’s “Vietnamization” policy accelerated, American troops and casualties diminished rapidly, and media coverage of the war declined proportionately. America’s last memorable snapshot of Vietnam was of those desperate people clinging to the skids of the last helicopter lifting off the roof of the American Embassy as the victorious North Vietnamese overran the entire country. That event in 1975 seemed to put the final seal on the first “lost war” in U.S. History.

Though there was little general interest at the time, and even less among subsequent historians the question remains: What happened during those final seven years and should it matter to us?

All of which brings us to an examination of Lewis Sorley’s masterful history A Better War: The Unexamined Victories and Final Tragedy of America’s Last Years in Vietnam.

First appearing in 1999 Sorley’s book received limited attention even though – or perhaps because- it seriously challenged the conventional wisdom regarding the “lost war”. Nonetheless, given its’ highly impressive research base- tapping heretofore untouched primary sources- and simple but compellingly argued thesis the book was respectfully reviewed even by traditionally liberal outlets such as the New York Times (“ a comprehensive and long overdue examination of the immediate post-Tet offensive years”) and the Washington Post (“the post-1968 war clearly deserves more attention and a more positive appraisal than most historians have given it. A Better War helps fill the gap.”)

Foreign Affairs described the book as “Forcefully and convincingly argued… a provocative and important contribution to the history of the Vietnam War” and the Wall St. Journal noted that “the successes in 1968-72 period have disappeared down the memory hole. Lewis Sorley fills in those blanks with his important new book”.

A Better War has received a new prominence in recent years because of its great relevance to the American challenges in both Iraq and Afghanistan. David Ignatius of the Washington Post called it “the hot book among Iraq strategists” and noted its presence on the bookshelves of senior military officers in Baghdad and in the speeches of Condoleezza Rice.

A third generation graduate of West Point who also holds a doctorate in history form Johns Hopkins university, Lewis Sorley served as a tank commander in Vietnam and on staff at the Pentagon. He later was a senior civilian official at the Central Intelligence Agency, and since retirement has been the author of several well received military histories focusing on Vietnam.

At its heart A Better War is about one horrible mistake that brought catastrophe to America and Vietnam, and one extraordinary man who heroically came very close to redeeming that mistake.

The mistake was the appointment and sustaining of General William Westmoreland as supreme U.S. commander in Vietnam (1964-68). Westmoreland will go down in U.S. history as the most disastrous senior commander since George Mc Clellan led the Union armies in the Civil War. McClellan very nearly lost the Civil War for Abraham Lincoln. Westmoreland did lose the Vietnam War for Lyndon Johnson.

Westmoreland was selected from a list of four senior generals submitted to Johnson in January 1964. He owed his appointment to a chance fortuitous encounter with John F. Kennedy and the behind the scenes machinations of General Maxwell Taylor.

The three generals who were passed over all were advocates of and would have pursued a Vietnam strategy called “clear and hold”. Westmoreland thought differently. He inaugurated and for four years doggedly pursued a strategy called “search and destroy” predicated on the notion that if you killed enough enemy soldiers (hence the infamous “body counts”) they would eventually give up. To achieve this goal Westmoreland constantly asked for- and almost to the end always got- “more troops”. However even when he commanded over half a million men Westmoreland found that North Vietnam was replacing its soldiers even faster than he could kill them. The Tet Offensive was but the final and very public demonstration of the total bankruptcy of Westmoreland’s “search and destroy” strategy. David Halberstam’s classic The Best and the Brightest brilliantly chronicles this failure and the foolhardiness of the senior officials- L.B.J., McNamara, Taylor, etc.- who supported it.

The bulk of Sorley’s book commences its account of the war at precisely the point where most American people and politicians had concluded that it was a lost cause. It revolves around that extraordinary man who came very close to retrieving the colossal blunders of Westmoreland and his superiors, and in fact very close to winning the “lost war” outright.

That man was Creighton W. Abrams (1914-1974) who succeeded Westmoreland in 1968 and served four years as American commander in Vietnam. Though the war would be lost-not for military but for political reasons- after Abrams departure in 1972 his accomplishments during his four year tenure distinguish him as the greatest American commander since World War II.

In 1944 the brilliant though egomaniacal General George Patton said “They say I am the best tank commander in the U.S. army, but I have one peer-Abe Abrams”. Building on his magnificent performance in the Battle of the Bulge which occasioned Patton’s high praise, Abrams served with distinction through twenty years, and in 1964 was one of the three men LBJ passed over to appoint Westmoreland.

In mid 1968 Abrams succeeded Westmoreland and immediately implemented a dramatic change in both strategy and tactics. He abandoned “search and destroy” with its costly large unit sweeps through the remoter and thinly populated regions of Vietnam.

Abrams decided to let the enemy come to him and fight him while protecting the Vietnamese people. Instead of the large unit actions where the enemy always knew what the Americans were up to and thus could always choose points of battle favorable to them, Abrams substituted constant “patrolling” by large numbers of small units (5 to 10 men) that continually probed the countryside gathering intelligence from local people, and destroying enemy supply caches and generally disrupting the foe’s movements before he could concentrate.

Tet had been a propaganda triumph for the communists but a military disaster. The price they paid was the near total destruction of the indigenous Viet Cong. Thereafter-as Abrams knew-all enemy soldiers and supplies had to come from North Vietnam through Laos and Cambodia via the “Ho Chi Minh Trail”. Accordingly Abrams gave high priority to sharply upgrading both human and electronic intelligence so that soon Americans knew in great detail the movements of the thousands of Chinese and Russian made trucks ferrying men and supplies from North Vietnam. After 1968 the sharply increased volume and accuracy of American precision bombing at all junction points along the Ho Chi Minh Trail had devastating effect on North Vietnam’s ability to sustain its war effort.

Very soon after the 1968 U.S. Presidential election Abrams knew that Richard Nixon’s plan for Vietnam involved a responsible but rapid draw-down of the 543,000 American soldiers under his command. Thus in Abrams view he had a specific “window of opportunity” to win the war- always his main objective- and hand over responsibility for the security of the country to a South Vietnamese government and military that could successfully maintain it at the very same time his army was heading home. (Does anyone doubt how closely Generals Petraeus and McChrystal read this book?)

Westmoreland had essentially decided that Americans could win without much help from the South Vietnamese to whom he gave inadequate support and less respect. Abrams took the opposite approach. He knew that in the end the South Vietnamese would have to do the job without much help from the Americans. Accordingly he sought to gain their trust by offering a full measure of support and respect.

In pursuing his tasks Abrams was fortunate to gain two extraordinary partners within the same year he arrived.

Ellsworth Bunker, a courtly low-key septuagenarian international businessman turned diplomat replaced the often overbearing and manipulative Maxwell Taylor as U.S. Ambassador to South Vietnam and rapidly built a trusting and respectful relationship with the country’s President Nguyen Van Thieu.

Soon after taking command Abrams fired Robert Komer, the erratic and arrogant head of the rural pacification program and replaced him with the highly talented William Colby, a career CIA officer who would later head that Agency. Colby entirely reconstituted the pacification and strategic hamlet program and launched Operation Phoenix which rooted out the Viet Cong’s “shadow government” and in close cooperation with President Thieu swiftly spread an umbrella of security, support, and land redistribution throughout South Vietnam’s countryside.

Together for four years this highly simpatico trio gave the American effort in Vietnam a cohesion, energy, imagination, and deep sense of mission that had been entirely lacking in the Westmoreland era.

Central to their achievement was the vital growth of the popularity, effectiveness, and military capacity of the South Vietnamese government as it gradually and successfully took up the daunting challenge of standing on its own in the wake of the rapidly accelerating American troop withdrawals.

By 1971 Ambassador Bunker could report his ability to travel throughout the countryside in an unescorted open Jeep- always wearing his signature suit and tie –for days without seeing any evidence of communist activity, and he also reported that the million plus residents of Saigon “enjoyed a higher level of safety, law and order than their counterparts in Los Angeles or Chicago.”

Abrams took particular pride in the continued high morale and effectiveness of U.S. troops even as their numbers dwindled. He greatly resented the misleading media stories about rampant problems regarding drugs and race relations, and pointed to surveys showing that such problems among soldiers in Vietnam were significantly less than among service personnel serving elsewhere in the world and markedly less than among comparable populations in the United States.

Abrams was also at pains to debunk the media myth that the Vietnam War was largely fought by draftees from the underclass. Of the 2.6 million men who served in the Vietnam theatre fully two thirds were volunteers and demographically almost a perfect reflection of the U.S. population as a whole. Surveys taken at the time and even twenty years later after the war had been lost showed, that U.S. soldiers overwhelmingly took pride in their service and regarded their mission as an important cause.

By 1972 Abrams command was down to a mere 49,000 soldiers. He wryly noted that it was the first time an American army had gone home and left its commander behind.

In contrast South Vietnam had 1.1 million men under arms. In another major departure from the Westmoreland era Abrams gave high priority to seeing that the Army of the Republic of Vietnam (ARVN) received high quality equipment and training.

The dramatically improved ARVN fighting qualities and their ability to hold their own against North Vietnamese regulars was shown clearly in the two largest set piece battles of the entire war. The first –Lam Son 719- in the spring of 1971 saw tens of thousands of ARVN troops entering the Laotian panhandle unaccompanied by any U.S. ground personnel to interdict a major North Vietnamese offensive aimed at the South. At the height of the battle the two armies had over 100,000 men in the field. The ARVN was severely mauled but the losses sustained by the North Vietnamese Army (NVA) were so severe that they were unable to launch any further offensive activity for the remainder of 1971.

The second major battle was the Easter offensive of 1972 which the NVA launched directly across the Demilitarized Zone (DMZ) in South Vietnam. This proved to be an even more devastating defeat for the NVA which suffered over 100,000 casualties-about 40,000 killed – and lost over half its tanks and artillery. These losses were so severe that the NVA was unable to launch another major offensive for three years, and also led to the removal of the NVA’s legendary commander General Vo Nguyen Giap.

While the might of U.S. air power-from helicopters to B-52 bombers- was a critical difference maker for ARVN, these troops again and again showed themselves in combat to be as tough and tenacious as their enemy.

While the focus of A Better War is on events in Vietnam, the book like the war itself unfolds against the critical backdrop of the political situation in the United States and the ongoing peace negotiations in Paris.

By the end of 1972 Richard Nixon’s “Vietnamization” policy had achieved a remarkable level of success. Ninety percent of the 543,000 American troops serving when he took office had been withdrawn from Vietnam; their combat role successfully taken over by ARVN troops. Vietnam had been pacified, the government of President Thieu enjoyed wide popular support, and had shown it was capable of defending itself against North Vietnamese aggression.

In giving Nixon a landslide re-election victory over Democrat George Mc Govern the American people affirmed their support for the former’s approach to ending the war on honorable terms.

Absolutely essential to sustaining the success of “Vietnamization” was America’s determination to continue strong logistical and financial support for South Vietnam much as we had done for South Korea.

When North Vietnam withdrew from the Paris peace negotiations in December 1972, Nixon demonstrated such determination by ordering resumed B-52 bombing of rail yards, marshalling areas, petroleum storage facilities, missile storage sites, docks and warehouses in the Hanoi- Haiphong area. North Vietnam’s official history- which Sorley utilized extensively- conceded that “Nixon proved extremely obstinate and reckless, and did things Johnson never dared to do”.

After eleven days bombing Hanoi reversed their bargaining position and on December 28th announced they would return to the peace talks.

Describing what he called the “ultimate irony” historian George Herring stated that “the U.S. position in South Vietnam was stronger at the end of 1972 than at any previous point in the war.” Respected Vietnam authority Sir Robert Thompson said that the U.S. at this point could have dictated peace terms and that “the war could have been won, in that a real and enforceable peace could have been obtained”. He further added “In my view, on December 30, 1972, after eleven days of those B-52 attacks on the Hanoi area, you had won the war. It was over!”

So, if the “unwinnable” war had been won- confirmed by the signing of the Paris Peace Accord on January 27, 1973- how was “defeat snatched from the jaws of victory?”

Sorley answers this question persuasively by using the words of North Vietnamese leaders as found in their extensive memoirs and official histories. Ever since the U.S. domestic upheavals of 1968 North Vietnam’s leadership saw U.S. political turmoil as their best hope of victory. NVA Colonel Bui Tin wrote how “Every day our leadership would listen to world news over the radio at 9 a.m. to follow the growth of the American anti-war movement. Visits to Hanoi by people like Jane Fonda and former a

Attorney General Ramsey Clark and ministers gave us confidence that we should hold on in the face of battlefield reverses.” The North Vietnamese were also keenly aware of the Democratic controlled Congress’ visceral antipathy toward Richard Nixon, a sentiment strongly shared by American media and intellectuals.

Though all American troops were gone soon after the signing of the Peace Accords, and the NVA – in violation of the Accords- almost immediately began launching attacks, the South Vietnamese more than held their own. As U.S. observer Major General Ira Hunt reported “for about two years (1973-74) the ARVN were cleaning their clocks. The South Vietnamese were giving more than they were getting, there’s no question about it. But when we pulled the plug logistically there was no way they could carry on.”

And “pull the plug “ was exactly what the Democratic Congress did in rapidly escalating budget cuts during the same two year period until by early 1975 all support- from air power to money- was completely cut off- all this at the very same time that both Russia and China were dramatically increasing their support and supply for North Vietnam.

The Democrats ability to do this so completely was greatly facilitated by the political destruction of Richard Nixon by the Watergate scandal of 1973-74. As the NVA’s Colonel Bui Tin observed, the resignation of Nixon on August 9, 1974 was final proof to North Vietnam’s leaders that they would win the war.

Though ARVN fought valiantly in the final six months of the war, at the end many of their troops were reduced to having to purchase their own bullets and grenades, while their enemy bombarded them with a limitless supply of artillery shells made in Russia and China. This led Sir Robert Thompson to observe “that perhaps the major lesson of the Vietnam War is: do not rely on the United States as an ally.”

The title of Sorley’s book comes from an observation made in Saigon in 1969 by the New Yorker correspondent Robert Shaplen: “You know its too bad. Abrams is very good. He deserves a better war.” Many years after the war ended someone reminded the eldest of Abram’s three sons –all army officers- of Shaplen’s remark. Without hesitation young Creighton replied “He didn’t see it that way. He thought the Vietnamese were worth it.”

Among other things Sorley’s superb book is a rumination on the element of chance in history. What if the general LBJ selected in 1964 was Abrams not Westmoreland. What if Abrams had successfully pursued his preferred strategy in the four years prior to 1968 when the American people, the Congress, the Democratic Party, and even the media supported the war rather the four years after 1968 when all of the above had essentially given up.

How different might the outcome have been for a still polarized American Society? How different for the 58,000 Americans who died in Vietnam, or the 275,000 ARVN killed in action, the 465,000 dead civilians, the 65,000 executed by their liberators, the 250,000 who perished in the brutal “re-education camps”, or the 2,000,000 who became refugees?

When another great war hung in the balance Winston Churchill memorably observed that “the terrible ifs accumulate.” America today is still haunted by the terrible ifs of Vietnam. ______________________________________________________________________

BHO 2010 echoes FDR 1938

When praising his own “accomplishments” Barack Obama has an unusual fondness for the word “unprecedented” though invariably his assertions lack any historical validity. In contrast the voters of Massachusetts can now claim an accomplishment that entirely justifies the use of that word. To find an event in American history reasonably comparable in character and impact to the Massachusetts Earthquake we must go all the way back to Franklin Roosevelt’s 1937 attempt to “pack” the Supreme Court. That is the last-perhaps the only- time in our history that a President commanding huge congressional majorities sought with breathtaking arrogance to redesign the constitutional, social and economic foundations of the country and was stunningly defeated by the very people who long had been his party’s staunchest supporters.

With a righteousness and sense of invincibility engendered by three consecutive triumphal election cycles that had given him and his party an extraordinary dominance Roosevelt sought to demonize the “nine old men” of the Supreme Court who had the temerity to strike down key elements of the New Deal as unconstitutional. With little consultation outside his inner circle and apparent indifference to how such a radical move would be received in the country Roosevelt advanced sweeping legislation that would increase the membership of the Supreme Court from nine to fifteen and replace lifetime appointment with mandatory retirement ages, moves which would enable him to swiftly “pack” the Court with hand-picked minions.

It was at this point that ordinary Americans and several key Democratic leaders like Montana’s Senator Burton K. Wheeler decided that Roosevelt’s radical power grab was going too far and actively threatened the nation’s hallowed Constitutional traditions. The Court “packing” scheme was decisively defeated in the Congress and the final political result was the Democratic Party losing seven Senate and 80 House seats in the 1938 mid-term elections.

That was America’s last peacetime election before World War II restored the country’s economy, ended the Great Depression, and redeemed the political fortunes and historical reputation of Franklin Roosevelt. Nonetheless 1937 remains a decisive turning point in American history when the overarching ambition of a well-intended but tone deaf President were dramatically rebuffed by a most unlikely combination of opponents who read the national mood far better than he.

The week that saw the unbelievably improbable election of Scott Brown in Massachusetts also witnessed the startling collapse of the recently “inevitable” Obamacare legislation, and the absolute implosion of the Democratic Party in a tawdry spectacle of shock, fear, anger, finger-pointing, pseudo-contrition, confusion, chaos, and general cluelessness.

Not in living memory has a dominant political party been so devastated, so quickly by a single wildly unpredictable event.

It is easier to search the past for perspective on this American melodrama, than to divine its future conclusion. Much will turn on the choices made by the Democratic Party. Will there be a Clintonesque dash to the center, (“the end of big government and welfare as we know it”) by a President in hot pursuit of re-election?

Or, will the Party in certain knowledge that it will never again enjoy such Congressional dominance heed the frenzied howls of its far left and “double-down” on the strategies of bigger government, redistributionist legislation, and intolerable taxation that have so alienated the public?

Rational calculation would seem to demand the former direction, but in critical degree today’s Democratic Party is far more radical than the Party that was dethroned in 1994. The dominant Furies that energize and fund the Democrats are of an ideologically obsessed mindset unlike anything that ever before captured control of a major American political party.

President Obama’s utterances since the upheaval are suggestive of self-pity and delusion. Excusing his inattentiveness because he was “so busy getting stuff done” and then claiming that both he and Scott Brown were elected by the same anger at George Bush bespeaks a man quite out of touch with reality. His lame attempt at populism-Let’s punish those greedy bankers- is nothing but the class warfare and general assault on capitalism that has been the thinly disguised agenda of the Obama-Pelosi-Reid Axis from the beginning. What’s new is that now the American people know it and are determined with their votes to decisively defeat it.

Old movies and unwelcome history

The moment the Japanese Empire bombed Pearl Harbor, the vast majority of Americans were committed heart and soul to winning the world war that the sneak attack abruptly brought our nation into. But as welcome as the ultimate victory was, World War II’s conclusion was, like most wars, a mixed blessing. For while the Nazis, fascists and warlords were thoroughly defeated, one of our principal allies, the Union of Soviet Socialist Republics (deceased, 1991) was in command of central Europe and portions of the Far East. No less pleased at the outcome as the western allies–the United States, Great Britain and France–the USSR nevertheless was a regime no less hateful than the ones defeated in war. In Europe, a divided continent entailed further divisions within defeated countries, specifically, Germany and Austria. In both countries, four zones of occupation were established at the Potsdam Conference, not only for these countries but for their capital cities, Berlin and Vienna. The division of Germany epitomized the tragic results of the "good war," as it came to be called, with crises in 1948 and 1961 that threatened another world war, and the remarkably peaceful outcome of 1989 with the fall of the Berlin Wall, erected in 1961. Austria was more fortunate, as the four-power occupation of the country and its capital ended with its official neutrality, agreed to at a summit conference in 1955.

But, of course, this was not the case in the immediate aftermath of the war, as painfully the true nature of our Soviet allies became clear. It was bad enough that Soviet troops remained from the Baltic republics to Bulgaria. But even those persons in Russia and its satellites who managed to flee ahead of those troops to the western democracies were relentlessly pursued by Soviet authorities.

Operation Keelhaul was the wrenching obligation of Western powers to deal with the Soviet refugee "problem." Aleksandr Solzhenitsyn, the heroic Russian writer who took on the Communist colossus and ultimately won, denounced even the estimable Winston Churchill for consenting to this massive human tragedy. Because the operation mocked everything the victorious allies fought (and prosecuted German and Japanese leaders) for, it was given little publicity.

But movie makers in those days took note. "The Red Danube," an MGM production of 1949, (shown on TCM) zeroed in on the grisly work of Soviet repatriation with telling effect. Despite the British occupation forces’ determination to carry out their orders to deliver thousands of unhappy and unwilling refugees from Soviet tyranny to their horrible and undeserved fate, the truth obtrudes itself.

Here is a useful plot summary from IMDb (Internet Movie Database):

"Shortly after the end of World War II, British Colonel Michael 'Hooky' Nicobar (Walter Pidgeon) is assigned to a unit in the British Zone of Vienna. His duty is to aid the Soviet authorities to repatriate citizens of the Soviet Union, many of whom prefer not to return to their home country. Billeted in the convent run by Mother Auxilia (Ethel Barrymore), Nicobar, and his military aides Major John 'Twingo' McPhimister (Peter Lawford) and Audrey Quail (Angela Lansbury), become involved in the plight of a young ballerina (Janet Leigh) who is trying to avoid being returned to Moscow. Nicobar's sense of duty is tested as he sees first hand the plight of the people he is helping return to the Soviet Union; his lack of religious faith is also shaken by his contact with the Mother Superior."

I read several of these plot summaries, all of which equivocated in some way on the momentous issues involved. To say that "many" of the Soviet citizens "prefer[red] not to return to their home country" is a huge understatement. All were actively hostile to the idea, for it does not take a genius to figure out that a regime that deprives you of your liberty is to be avoided at all costs. Other summaries called the movie "propaganda" and "heavy handed." That’s how things appear to those who are either ignorant of political realities or wilfully blind for the sake of avoiding conflict.

But the summaries indicate that there are several threads in this movie. Front and center is the painful dilemma of the officers of a good regime being ordered to deliver unwilling people to an evil one. The film "humanizes" this weighty issue with a young officer’s passion for a beautiful victim of the massive roundup. (The officer’s aide is also in love with him.) So our hearts tug for the young couple’s fight to avoid her repatriation and hurt badly when events conspire against them.

Col. Nicobar’s sense of duty, reinforced at all levels of the British command, is not hard to admire, but our awareness of the evils it brings about forces us to stop and think. As determined as he is to carry out his orders, a combination of the true facts of the repatriation and his being prodded by the mother superior, produce a far different outcome. Looking back at the event, today’s reviewers reflect the influence of postwar revisionism that refuses to acknowledge that the Cold War was rooted in Soviet tyranny, and of "political correctness" that all too incorrectly seeks to banish religious issues from public discussion.

The good-hearted and honest colonel has difficulty reconciling the existence of massive evil in the world with the promise of love and peace that is the Christian message. He is not one to change his mind easily for, as John Adams long ago observed, "facts are stubborn things." Not only Nazi atrocities but, as he is painfully learning, Soviet atrocities shake the world, leaving men like him with the unending duty of opposing them by force. Religious sentiment, he believes, is no better than rank superstition in the face of these great evils.

Gently, but firmly, the mother superior reminds him, by her persistence in fighting for Maria’s release and even publicizing the whole repatriation issue with the Pope, as well as by her pointed observation that God did not do these wicked deeds but man, Nicobar sees a new and more compelling duty to risk his position and his sustenance by refusing to carry out any further cooperation with the Soviets’ nefarious project. The denouement will bring delight to every lover of liberty and freedom of conscience.

Momentous issues at mid century gave many people a sense of moral clarity than has seldom been seen since. We can be grateful to old Hollywood (and Turner Classic Movies) that it made films worthy of the best characters that humanity has put forth. May it plague the consciences of those who will not see the truth that is right in front of them.

Constitution Day 2009

Perpetuation of Our Political InstitutionsBy Greg Schaller

On September 17, 1787, thirty-nine of the delegates at the Constitutional Convention, having met for four long, hot, and humid summer months in Philadelphia, had finally completed their task. On that day, they lined up and signed their names to the completed document. The debates had often been heated and the disagreements significant, concerning the powers of the national government, the representation of the states, and, of course, slavery. Yet in the end, the final version was a Constitution that has endured for over 221 years. It is the longest surviving, working constitution in the world today. The Constitution is indeed worthy of respect and honor because of its long survival. But survival of a regime and survival of a constitution is not good in and of itself; just as survival of a tradition isn’t good for its own sake. The perpetuation of a tradition or a Constitution must be judged on what it is, not simply on its endurance. We can all think of many examples of governments around the world that are surviving, but that we (as well as its citizens) would certainly prefer to see fail.

Abraham Lincoln delivered the eulogy for a man he admired greatly: Henry Clay. Clay was an early leader of the Whig party, to which Lincoln was a member before the Republican Party emerged. In his eulogy, Lincoln said of Clay: “He loved his country partly because it was his own country, and mostly because it was a free country; and he burned with a zeal for its advancement, prosperity, and glory, because he saw in such the advancement, prosperity, and glory of human liberty, human right, and human nature. He desired the prosperity of his countrymen, partly because they were his countrymen, but chiefly to show to the world that free men could be prosperous.”

Henry Clay was patriotic toward his country. But his patriotism was not a blind faith loyalty based simply on the fact that he resided here. It was a loyalty to both the principles of the founding and the Constitution crafted from those principles. Lincoln shared this loyalty and dedicated his presidency to the preservation of the Union and its Constitution. However, Lincoln would have been the first to admit that had the Union not been worth preserving (because of what it was about), it certainly wouldn’t have been worth the loss of over 600,000 lives in the Civil War in order to preserve it. So what was and is so significant about our Constitution that Lincoln was convinced that waging a lengthy war at the cost of so many lives was indeed worthwhile.

When we discuss the significance of the struggle to preserve the Constitution, we need to be clear on two things: first, what exactly are we preserving; and second, what is the nature of the attack that is being made against it.

Be clear, our Constitution is under attack. The center of the attack is made against the two things Lincoln thought were so important to save: the Constitution and the concept of the “rule of law” that is essential to the Constitution’s preservation. The method of attack is two-pronged. The first is to debunk the text and original meaning of the Constitution. The second line of attack argues that we can re-interpret the text whenever we deem it necessary and when it suits our purposes.

Today there are two primary and competing schools of thought when it comes to Constitutional interpretation. The first school is described well by former United States Supreme Court Justice William Brennan.

In a speech delivered at Georgetown University in 1985, Brennan claimed that “the genius of the Constitution rests not in any static meaning it might have had in a world that is dead and gone, but in the adaptability of its great principles to cope with current problems and current needs.”

What Brennan was in fact saying was that the text of the Constitution really has no meaning, or a least no meaning other than what we happen to decide to give it today, regardless of whether our modern interpretation has any resemblance to the intent of its authors. This perspective is also unconcerned as to whether or not our interpretation will be completely different in 50 years, 20 years, 1 year, or even tomorrow. What Brennan describes is a school of constitutional interpretation that favors a “living” or “evolving” constitution. The meaning of the text is no more than what we choose to give it, and we grant ourselves great latitude to change our interpretation any time public opinion has changed.

It is this school of interpretation that has given us the remarkable constitutional “reasoning” in several recent cases of, “the evolving standards of decency.” This argument has been put forth most notably in recent capital punishment cases. To see how this works, considering two recent cases will suffice. In 1989 the Supreme Court concluded that it was constitutional to execute individuals with low I.Q.s. The majority concluded this because there did not exist at the time a consensus among the states as to whether or not such practice would offend the 8th Amendment. However, just a few years later in 2002, the Supreme Court concluded that we could no longer continue this practice. Why? Because of the “evolving standards of decency.” According to this interpretation of the Constitution, the 8th Amendment prohibition of cruel and unusual punishment is completely dependent upon public opinion! Thus the rightness or wrongness is not determined by the text of the constitution, the principles behind it, or the intent of its authors. Rather, it is simply the adaptive interpretation as exhibited through public opinion. This understanding assumes that constitutional interpretation is simply majority will and that this will determines the rightness or wrongness of something. Of course, if we follow this argument to its logical conclusion, the institution of slavery was right, as long as it had popular support!

The competing school of interpretation argues that rather than having a living and evolving meaning, the Constitution has an “original intent”, and that American jurisprudence is based upon it. With this understanding, our application of the laws, and interpretation of the Constitution is bound by the intentions of those who ratified it. Obviously, this interpretation is in stark contrast to the constitution of Brennan that has no “static meaning”, and is forever adaptable.

If we view our Constitution as meaning only what we want it to mean, when we want it to mean that, we are violating the principles of rule of law and constitutionalism. Rule of law is based upon the need to have consistency of law, equal treatment of the law and everyone being “under” the law. Central to the need for consistency of law is that the law, and more importantly, the Constitution from which our laws are crafted, has a sense of permanence that is not easily altered. I am, of course, not making the argument that our Constitution is perfect, nor am I saying that improvements to it are impossible. The point is that there is a proper and deliberate method of changing the Constitution through amendments. The answer to changing the Constitution is not to have five Supreme Court justices simply redefine the terms for us, nor for we as the citizens of the Constitution to be disinterested or apathetic and idly watch as infringements on our Constitution take place through executive and legislative fiat.

Lincoln warned us that the greatest threat to the Union would not come from an outside force, but instead, from within. In his famous Lyceum Address, he stated: “At what point, then, is the approach of danger to be expected? I answer, if it ever reach us it must spring up amongst us. It cannot come from abroad. If destruction be our lot, we must ourselves be its author and finisher.”

The title of Lincoln’s Lyceum address was: “The Perpetuation of Our Political Institutions.” His audience was somewhat stunned that he would question the survival of the Union and her constitution. When he delivered his speech in 1838, most of his audience had concluded that the country was a well-oiled machine with no chance of faltering. Of course, it was not long after that speech that the Union did face its crisis of survival. Lincoln believed that the seeds of the movement toward secession, when the South refused to accept the results of the constitutionally held election of 1860, were sown decades earlier, when a growing mindset of disobedience to law and a weakening of the loyalty to the Constitution was growing.

My point is not to be an alarmist. Rather, it is to have us return to Lincoln’s concern for the nation: does she reverently hold to the hard work laid out by the founding fathers, the principles of the Declaration, and the Constitution created in order to establish a More Perfect Union? Failing that devotion, a breakdown of constitutionalism and rule of law are certain to take place.

Racism is alive and well--among Dems

As the growing extent and intensity of public opposition to the Obama Administration’s policies threaten to shut down its agenda, defenders of the Administration have resorted to systematic name calling. The most favored epithet is "racist." No less a personage than former President James Earl Carter last week alleged that most of the opposition to the Obama agenda is due to the President’s partly African origins. It is amazing that those same voters who cast their ballots for the President last year but are opposed to his agenda now suddenly have become transformed from public-spirited citizens into bigots.

Democrats have been calling Republicans racists for years, and it is as false as ever. It was the Republican party, after all, which brought about an end to slavery against powerful Democrat opposition. And it was the southern Democrats who maintained apartheid for a century after emancipation and who opposed civil rights legislation until President John Kennedy reluctantly supported Rev. Martin Luther King Jr.’s efforts to end segregation.

In fact, a greater percentage of Republicans than Democrats supported the omnibus Civil Rights Act of 1964, as such southern "liberals" as William Fulbright and Albert Gore, Sr., and former Ku Klux Klan member Robert Byrd, voted "no.".

Kennedy owed his election in the close 1960 contest to the heavy support of black voters in our largest cities, largely because he won the support of King over Republican Richard Nixon. This came at an opportune time, for growing numbers of suburban dwellers were supporting the Republican party.

In spite of the long history of Democrat racism, party leaders seized upon the opposition to the civil rights bill of the 1964 Republican presidential nominee, Sen. Barry Goldwater. Goldwater had a history of opposition to segregation in his home state of Arizona, having desegregated the National Guard. But he believed that the Constitution prohibited the federal government from regulating matters of state jurisdiction.

That vote won Goldwater only five southern states plus Arizona, as he lost to Lyndon Johnson in a landslide. But his opposition to the civil rights bill was enough to earn the racist tag for his party. When Richard Nixon picked a border state governor as his running mate in 1968, enabling him to win several southern states in a very close election, the racist tag stuck.

It is too bad that, in retrospect, Goldwater’s worst fears were vindicated, as the Great Society corrupted the principle of equality from opportunity to entitlement, with affirmative action, goals and timetables and even racial quotas–racial discrimination in reverse.

The same Lyndon Johnson who, as Senate majority leader in the 1950s watered down Republican-sponsored civil rights legislation, became a "born again" civil rights advocate when the electoral needs of his party dictated the shift. But the shocking–and revealing–fact is that there was no change in principle. Whereas Democrat racism once took the form of favoritism for whites, it easily slid over to favoritism for members of racial minorities.

As former President George W. Bush put it one of his 2000 campaign speeches, the Democrats now preach "the soft bigotry of low expectations." Instead of keeping blacks down by denying them the opportunity to advance of their own merits, Democrats now favor hiring or promoting employees, or admitting students, on the basis of their race or ethnicity.

In what black journalist and author Star Parker identifies as the "government plantation," having what used to be called in the slave and segregated South "one drop of Negro blood" makes all the difference. What previously closed doors for millions now opens them.

But it is a trap. Unearned advantages antagonize those losing out, even as the fact of favoritism is not lost on the supposed beneficiaries. "Soft bigotry" benefits only those who, like the slave masters and racists of old, determine who wins and who loses. The modern bureaucratic state, once thought to be based on merit, now teaches us every day that race trumps character.

When Democrats call their critics "racists," they are engaging in what psychologists identify as "projection." Painfully aware of their racist history, Democrats convince themselves that in their current pose as the friend of racial minorities they alone can be trusted with political power. They imagine that Republicans, who do not pose as friends but actually support equal rights, must be racists too unenlightened to appreciate Democrats’ allegedly good intentions.

Democrats believe that if they call Republicans racists long enough the people will forget about slavery and segregation. But the existence of the race-based government plantation gives the whole show away. Race is the Democrat calling card.
